Ali ibn Ibrahim has narrated from his father from ibn abu ‘Umayr from Jamil ibn Darraj who has said the following: “This is concerning my question before abu ‘Abd Allah, ‘Alayhi al-Salam, about the case of a man who looks at a slave-girl whom he wants to buy; if she is lawful for his son. He (the Imam) said, ‘Yes, she is lawful unless he has looked at her private organs.”’

Un homme regarde une esclave qu'il souhaite acheter pour son fils, est-ce permis ? Il répondit : "Oui, sauf s'il regarde sa nudité."

4. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from ‘Abd Allah ibn Yahya al-Kahiliy who has said the following: “Once abu ‘Abd Allah, ‘Alayhi al-Salam, was asked, when I was with him (the Imam), about the case of a man who bought a slave-girl but did not touch her. His wife commanded his son, who was ten years old, to fall on her (for sexual intercourse) and he did it, now what do you say about it. He (the Imam) said, ‘The boy has sinned as well as his mother and it is not permissible for the father, after his son’s going near her, to fall on her.’ I then asked him (the Imam) about the case of a man who has a slave-girl and his father places his hand on her with lust or looks where it is not permissible to look with lust. He (the Imam) disliked his son’s touching her.’”

5. Muhammad ibn ‘Isma’il has narrated from al-Fadl ibn Shadhan from ibn abu ‘Umayr from Rib’iy ibn ‘Abd Allah from Muhammad ibn Muslim who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said, ‘If a man makes a slave-girl bare and places his hand on her she becomes unlawful for his son.’”

Quand un homme déshabille une esclave et pose sa main sur elle, elle ne devient pas licite pour son fils.

6. Abu Ali al-Ash’ariy has narrated from Muhammad ibn ‘Abd al-Jabbar from Safwan ibn Yahya from ibn Muskan from al-Hassan ibn Ziyad from Muhammad ibn Muslim who has said the following: “This is concerning my question before abu ‘Abd Allah, ‘Alayhi al-Salam, about the case of a man who has married a woman and has touched her. He (the Imam), ‘Alayhi al-Salam, said, ‘She is unlawful to his father and her mahr (dower) is obligatory.’”

"J'ai demandé à un homme qui avait épousé une femme et l'avait touchée : 'Est-ce permis pour lui ?' Il a répondu : 'C'est interdit pour son père, son fils et son mahr (dot) est obligatoire'."

7. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from Musa ibn Bakr from Zurarah who has said the following: “Abu Ja‘far, ‘Alayhi al-Salam, has said, ‘If a man commits fornication with the woman of his father or his slave-girl, it does not make her unlawful to her husband or the slave-girl unlawful to her master. If he goes to bed with a slave-girl who is lawful thereafter she becomes unlawful forever to his son and father. If a man marries a woman in a lawful way, that woman is not lawful for his father and son for marriage.

L'Imam Abu Ja'far (que la paix soit sur lui) a dit : "Si un homme commet l'adultère avec la femme de son père ou la servante de son père, cela ne rend pas cette femme interdite à son mari, et cela ne rend pas la servante interdite à son maître. Cela provient de lui-même. Si un homme a des relations conjugales avec une servante qui lui est licite, cette servante ne deviendra jamais licite pour son fils ni pour son père. Et si un homme se marie avec une femme de manière licite, cette femme ne deviendra jamais licite pour son père ni pour son fils."

8. A number of our people have narrated from Sahl ibn Ziyad from Ahmad ibn Muhammad from ibn abu Nasr from Hammad ibn ‘Uthaman from Murazim who has said the following: “I once heard abu ‘Abd Allah, ‘Alayhi al-Salam, saying, when he (the Imam) was asked about the case of a woman who commanded her son to fall on the slave-girl of his father and he did, ‘She has sinned and so has her son and certain ones of these people asked me about it and I said, “You can keep her because unlawful does not make lawful ones unlawful.’””

"Il a été demandé à Abu Abdullah (sur lui la paix) au sujet d'une femme qui a ordonné à son fils d'avoir des relations avec une esclave de son père, et il a eu des relations avec elle. Il a dit : Elle a commis un péché, de même que son fils. Certains d'entre eux m'ont interrogé à ce sujet et je leur ai dit : Retenez-le, car ce qui est licite n'est pas corrompu par ce qui est illicite."

9. A number of our people have narrated from Sahl ibn Ziyad from Musa ibn Ja’far from “Amr ibn Sa‘id from Musaddiq ibn Sadaqah from ‘Ammar who has said the following: “About the case of a man who has a slave-girl and his grandson falls on her (does sexual intercourse) before his grandfather or that a man commits fornication with a woman; if she is lawful for his father to marry, abu ‘Abd Allah, ‘Alayhi al-Salam, said, ‘No, it is not permissible. Only if the man marries her and goes to bed with her then his son commits fornication with her it does not harm him because unlawful does not make lawful ones unlawful and so also is the case of the slave-girl.’”

...concernant un homme qui possède une esclave et dont le fils de son fils la possède avant que le grand-père ne la possède. Ou un homme commet l'adultère avec une femme, est-il permis à son père de l'épouser ? Il a dit : Non, cela n'est permis que si un homme l'épouse, la consomme, puis que son fils commette l'adultère avec elle, cela ne lui porte pas préjudice, car ce qui est illicite ne corrompt pas ce qui est licite, de même pour l'esclave.
