Homme et femme fornicateurs

2. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Muhammad ibn ‘Isma’il from Muhammad ibn al-Fudayl from abu al-Sabbah al-Kinaniy who has said the following: “This is concerning my question before abu ‘Abd Allah, ‘Alayhi al-Salam, about the word of Allah, most Majestic, most Glorious, ‘A prostitute man cannot marry but a prostitute woman or a pagan.’ (24:4) He (the Imam) said, ‘They were well-known prostitute females and males. Today people who are convicted for fornication and punished (by the qualified court) are of the same status. No one must marry them unless it is known that they have repented.’”

Il y a des femmes connues pour la fornication et des hommes connus pour la fornication, ils sont reconnus pour cela, et les gens de nos jours sont à ce niveau-là. Celui sur qui la peine de la fornication est établie ou qui en est accusé, il n'est pas convenable qu'on le marie jusqu'à ce qu'il manifeste le repentir.

Al-Husayn from Muhammad has narrated from Mu’alla’ ibn Muhammad al-Hassan ibn Ali from Aban ibn ‘Uthman from Muhammad ibn Muslim who has said the following: “Abu Ja’far, ‘Alayhi al-Salam, about the word of Allah, most Majestic, most Glorious, ‘A prostitute man cannot marry but a prostitute woman or a pagan,’ (24:4) has said, ‘During the time of the Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, there were well-known prostitutes female and male. Allah, most Majestic, most Glorious, has prohibited forming marriage contract with such men and women. Today people who become known as such or are convicted for fornication and punished (by the qualified court) are of the same status. No one must marry them unless it is known that they have repented.’”

Celui qui commet l'adultère n'épousera que quelqu'un qui commet l'adultère ou une associatrice. Ils étaient des hommes et des femmes connus pour avoir commis l'adultère à l'époque du Messager d'Allah (que la prière d'Allah et Son salut soient sur lui et sa famille). Allah a interdit ces hommes et ces femmes, et les gens aujourd'hui sont sur cette même position. Si quelqu'un manifeste publiquement un tel comportement ou si le châtiment lui est infligé, ne le mariez pas jusqu'à ce que sa repentance soit connue.

4. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from Mu‘awiyah ibn Wahab who has said the following: “This is concerning my question before abu ‘Abd Allah, ‘Alayhi al-Salam, about the case of a man who marries a woman and afterwards finds out that she had committed fornication. He (the Imam) said, ‘If the husband wants he can take back from her guardian the mahr that he has paid, but she deserves the mahr because of which her marriage was made lawful, and if he wants he can separate from her (by means of divorce).”’

Si son mari le souhaite, il peut prendre la dot de celui qui l'a mariée, et elle a droit à la dot pour ce qu'il a licitement obtenu d'elle. Et s'il le souhaite, il peut la répudier.

5. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from ibn Faddal from ibn Bukayr from Zurarah ibn ‘A‘yan who has said the following: ��I once heard abu Ja‘far, ‘Alayhi al-Salam, saying, ‘There is no goodness in one who is born out of wedlock, not in his skin, his hair, his flesh, his blood and not in anything of him, the Ark (of Noah) failed to carry him even though dogs and pigs had embarked therein.’”

Je l'ai entendu dire : "Il n'y a aucun bien en l'enfant de la fornication, ni en sa chair, ni en ses cheveux, ni en sa viande, ni en son sang, ni en quoi que ce soit en lui que le navire ne puisse supporter, même si un chien ou un porc y était transporté."

6. Flumayd ibn Ziyad has narrated from al-Hassan ibn Muhammad ibn Sama‘ah from Ahmad ibn al-Hassan al-Mithamiy from Aban from Hakam ibn Hakim who has said the following: “About the words of Allah, most Majestic, most Glorious, ‘A prostitute man cannot marry but a prostitute woman or a pagan,’ (24:4) abu ‘Abd Allah, ‘Alayhi al-Salam, has said, This is about well- known, and openly committing prostitution.’ He (the Imam) then said, ’If one after committing fornication repents he can marry as he wants.’”

a dit : "Allah, le Puissant et Majestueux, a dit : 'L'homme fornicateur n'épousera qu'une femme fornicatrice ou polythéiste.' Il a dit : 'Cela concerne la fornication publique.' Puis il a dit : 'Si un homme commet la fornication puis se repent, il peut se marier où il le souhaite.'"
