1. A number of our people have narrated from Sahl ibn abu Nasr from Muhammad ibn Sama‘ah from Zurarah who has said the following: “I once asked abu Ja’far, ‘Alayhi al-Salam, about the case of a man who says to his wife, ‘You are unlawful for me.’ He (the Imam) said to me, ‘Had I the control over him I would give him a headache. You should have said to him that Allah has made her lawful for you then what has made her unlawful for you? In fact it (saying, ‘You are unlawful for me’) is nothing more than a lie. He thus has thought that what Allah has made lawful for him has become unlawful and there is no divorce or expiation on him? I then asked about the meaning of the words of Allah, most Majestic, most Glorious, ‘O Prophet, why do you make unlawful what Allah has made lawful for you’ (65:2) then expiation is made necessary.’ He (the Imam) said, ‘He only made unlawful for him his slave-girl, Maria and swore not to go near her. He, in the case of swearing, made expiation necessary not in the case of making something unlawful.’”
Un groupe de nos compagnons de Sahl ibn Ziyad, d'Ibn Abi Nasr, de Muhammad ibn Sama'a, de Zurara, d'Abu Ja'far (que la paix soit sur lui) a rapporté: J'ai interrogé Abu Ja'far (que la paix soit sur lui) au sujet d'un homme qui dit à sa femme: "Tu es interdite pour moi", et il me répondit: "Si j'avais autorité sur lui, je lui aurais infligé une punition corporelle. Je lui dis: "Allah t'a permis cela, pourquoi l'as-tu interdit pour toi?". Il n'a fait que mentir en prétendant que ce qu'Allah lui a permis est en réalité interdit pour lui. Le divorce et l'expiation ne lui sont pas applicables." Je dis: "La parole d'Allah, le Puissant et Majestueux: "Ô Prophète, pourquoi interdis-tu ce qu'Allah t'a rendu licite?" Il a imposé l'expiation dans le serment." Il dit: "Il a seulement interdit sa servante Maria et a juré de ne pas s'approcher d'elle. Il a imposé l'expiation dans le serment, mais il n'a pas imposé d'expiation dans l'interdiction."
