Divorce of a Pregnant Woman

1. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from ibn Faddal from ibn Bukayr from abu Basir who has said the following: “Abu ‘ Abd Allah, ‘Alayhi al-Salam, has said, ‘A pregnant woman is divorced once.’”

2. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad ibn ’Isma‘il ibn Bazi‘ from Muhammad ibn al-Fudayl from abu al- Sabbah al-Kinaniy who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said, ‘Divorce of a pregnant woman is once and her waiting period is the closest of the two periods, (that is, childbirth or three months).’”

3. Flumayd ibn Ziyad has narrated from al-Hassan ibn Muhammad ibn Sama‘ah from ‘Abd Allah ibn Jabalah and Ja‘far ibn Sama‘ah from Jamil from ’Isma‘il al-Ju‘fiy ’Isma‘il who has said the following: “Abu Ja‘far, ‘Alayhi al-Salam, has said, ‘Divorce of a pregnant woman is one and when she gives birth to what is inside her, she becomes stranger to him.’”

4. It is narrated from the narrator of the previous Hadith from ‘Abd Allah ibn Jabalah and from Safwan ibn Yahya from ibn Bukayr from abu Basir who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said, ‘A pregnant woman is divorced once.’”

5. A number of our people have narrated from Sahl ibn Ziyad from ibn abu Nasr from Jamil from ’Isma‘il al-Ju‘fiy who has said the following: “Abu Ja‘far, ‘Alayhi al-Salam, has said, ‘Divorce of a pregnant woman is one and when she gives birth she become stranger to him.’”

Abu Ali al-Ash‘ariy has narrated from Muhammad ibn ‘Abd al-Jabbar and abu al-‘Abbas al-Razzaz from Ayyub ibn Nuh all from Safwan from ibn Muskan from abu Basir who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said, ‘Divorce of a pregnant woman is one and her waiting period is childbirth, if it is the nearer of the two.’”

A number of our people have narrated from Ahmad ibn Muhammad from ibn Khalid and Ali ibn Ibrahim has narrated from his father from all from ‘Uthman ibn ‘Isa from Sama‘ah who has said the following: “I once asked him (the Imam), ‘Alayhi al-Salam, about the divorce of a pregnant woman. He (the Imam) said, ‘It is one and her waiting period is childbirth.’”

8. Ali ibn Ibrahim has narrated from his father from ibn abu ‘Umayr from Hammad from al-Halabiy who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said, ‘Divorce of a pregnant woman is one and her waiting period ends with childbirth if it is the nearer of the two.’”

Humayd ibn Ziyad has narrated from ibn Sama‘ah from al-Husayn ibn al-FIashim and Muhammad ibn Ziyad from ‘Abd al-Rahman ibn al-Hajja] who has said the following: “I once asked abu al-Hassan, ‘Alayhi al-Salam, about the case of a woman who is pregnant: if her husband divorces her and she gives birth prematurely or by abortion or it is just a lump. He (the Imam) said, ‘Whatever she gives birth to shows that she was pregnant, complete or not. Her waiting period is complete even if it is a lump.”’

Il a dit : "Tout ce qu'elle met au monde, il est clair que c'est une grossesse, qu'elle soit complète ou incomplète, et son 'iddah est alors terminée, même s'il s'agit d'un enfant mort-né."
10. It is narrated from the narrator of the previous Hadith from Ja‘far ibn Sama’ah from Ali ‘Imran al-Shifa’ from Rib‘iy ibn ‘ Abd Allah from ‘Abd al-Rahman ibn abu ‘Abd Allah al-Basriy who has said the following: “I once asked abu ‘Abd Allah, ‘Alayhi al-Salam, about the case of a man who divorces his pregnant wife with two children in her womb. She gives birth to one and one remains. He (the Imam) said, ‘She becomes stranger with the birth of one child and she is not lawful for marriage until the birth of the other child.’”*
IsnādJa'far ibn Samā'ah a rapporté d'après 'Alī ibn 'Imrān Ash-Shafā, de Rib'ī ibn 'Abdillāh, de 'Abd ar-Rahmān ibn Abī 'Abdillāh al-Basrī, de l'Imam Abu 'Abdillāh (que la paix soit sur lui) qui a dit:
J'ai interrogé l'Imam Abu 'Abdillāh (que la paix soit sur lui) au sujet d'un homme qui a répudié sa femme alors qu'elle était enceinte et qu'elle avait en son sein deux fœtus, puis elle a accouché de l'un d'eux et l'autre est resté. Il a répondu: "Il convient de clarifier la situation avec le premier et les époux ne sont pas autorisés à avoir des rapports intimes tant qu'elle n'a pas accouché de ce qui est en son sein."
11. It is narrated from the narrator of the previous Hadith from Safwan from Musa ibn Bakr from Zurarah who has said the following: “Abu Ja‘far, ‘Alayhi al-Salam, has said, ‘If a woman is divorced when she is pregnant her waiting period is childbirth even if she gives birth in the same hour.’”

12. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad and Ali ibn Ibrahim has narrated from his father from ibn Mahbub from abu Ayyub al-Khazzaz from Yazid al-Kunasiy who has said the following: “I once asked abu Ja‘far, ‘Alayhi al-Salam, about the divorce of a pregnant woman. He (the Imam) said, ‘She is divorced once for waiting period by months and in the presence of witnesses.’ I then asked, ‘Can he go back to her?’ He (the Imam) said, ‘Yes, she is his wife.’ (I then asked,) ‘What happens if he revokes the divorce, then decides to divorce once more?’ He (the Imam) said, ‘He cannot divorce until a month passes after he has touched her.’ I then asked, ’What happens if he divorces for the second time and arranges for witness about his revoking the divorce and touches her? Then he divorces for the third time in the presence of witnesses for waiting period of every month; if she becomes stranger like the woman who is divorced with waiting period because of which she is not lawful for her husband until she marries another man?’ He (the Imam) said, ‘Yes, it can happen.’ I then asked, ‘What is her waiting period?’ He (the Imam) said, ‘Her waiting period is giving birth to what is in her womb; then she becomes lawful for whoever wants to marry her.’”
IsnādMuhammad ibn Yahya, Ahmad ibn Muhammad, Ali ibn Ibrahim, son père, Ibn Mahbub, Abi Ayyub al-Khazzaz, Yazid al-Kunasi a dit: J'ai demandé à Abi Ja'far (que la paix soit sur lui) au sujet du divorce des femmes enceintes. Il a dit: Il peut la répudier une fois pendant la période d'attente en mois et en témoins. Je lui ai dit: Peut-il la reprendre? Il a dit: Oui, et elle est son épouse. J'ai dit: Et s'il la reprend, la touche, puis veut la répudier à nouveau? Il a dit: Il ne peut pas la répudier jusqu'à ce qu'un mois se soit écoulé pour elle après l'avoir touchée. J'ai dit: Et s'il la répudie une deuxième fois, témoigne, puis la reprend, témoigne de son retour, la touche, puis la répudie pour la troisième fois? Il a dit: Il témoigne de son divorce pour chaque période d'attente, un mois. Est-il clair pour lui comme il est clair pour la femme divorcée pendant la période d'attente où elle n'est pas permise à son mari jusqu'à ce qu'elle se marie à un autre? Il a dit: Oui. J'ai dit: Quelle est sa période d'attente? Il a dit: Sa période d'attente est qu'elle accouche de ce qu'elle porte, puis elle est permise aux maris.
Ceci est le contenu principal du hadith concernant les règles du divorce pour les femmes enceintes et les périodes d'attente à respecter avant qu'elles ne puissent se remarier.
