3. Muhammad has narrated from Ahmad ibn Muhammad ibn ‘Isa from Muhammad ibn Sinan from ‘Ammar ibn Marwan from Sama‘ah who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said, ‘Breastfeeding is for twenty-one months. Breastfeeding for less than this is injustice to the child.’”

"L'allaitement dure vingt-quatre mois, donc ce qui est en moins est considéré comme une injustice envers le bébé."

4. Ali ibn Ibrahim has narrated from his father and Ali Muhammad al-Qasaniy from al-Qasim ibn Muhammad al-Jawhariy from Sulayman ibn Dawud al-Minqariy who has said the following: “Once abu ‘Abd Allah, ‘Alayhi al-Salam, was asked about breastfeeding. He (the Imam) said, ‘A free woman cannot be forced to breastfeed; but the mother (who is a slave-girl) of child can be made to breastfeed.’”

Une femme libre ne doit pas être contrainte d'allaiter l'enfant, mais la mère de l'enfant doit être contrainte.

5. Ali has narrated from his father from ibn abu ‘Umayr from certain persons of our people from ibn abu Ya‘fur who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said that ’Amir al-Mu’minin issued a judgment about the case of a man who had died, had left behind a child and they had found someone to breastfeed him. He (the Imam) said that the wages for breastfeeding must be paid from what the child has inherited from his father and mother.’”

A dit l'Imam ‘Alī (que la paix soit sur lui) : "L'Imam des croyants (que la paix soit sur lui) a décrété concernant un homme décédé laissant un enfant en bas âge, qu'une nourrice soit désignée pour lui, et il a dit : La rémunération de l'allaitement de l'enfant provient de ce qu'il hérite de son père et de sa mère."

6. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Muhammad ibn ’Isma‘il and al-Husayn ibn Sa‘id all from Muhammad ibn al-Fudayl from abu al-Sabbah al-Kinaniy who has said the following: “I once asked abu ‘Abd Allah, ‘Alayhi al-Salam, about the words of Allah, most Majestic, most Glorious, ‘. . . a mother must not be harmed because of her child nor must a father be harmed because of his child.’ (2:232) He (the Imam) said, ‘This is a reference to the case of breastfeeding woman when man persued her for going to bed with her she refused saying, “I cannot allow you to go to bed with me because I may become pregnant and kill my child.’” It also refers to the case of the woman who asked a man for going to bed with her but he refused saying, “I am afraid that after going to bed with you then I will kill my child”; so he would not go to bed with her. Allah, most Majestic, most Glorious, prohibited man’s harming the woman or woman’s harming the man.’” Ali ibn Ibrahim has narrated from his father from ibn abu ‘Umayr from Hammad from al-Halabiy who has narrated a similar Hadith with this addition: “About His words, . . an heir has similar responsibilities . . (2:232), he (the Imam) said, ‘An heir must not harm the child or his mother during breastfeeding and she also must not take more than two complete years for breastfeeding the child. If they decide to wean the child by mutual agreement and consent before two years it is fine and separation is weaning.’”

J'ai demandé à lui (que la paix soit sur lui) au sujet de la parole d'Allah, exalté soit-Il : "Aucune mère ne doit être lésée à cause de son enfant, ni aucun père à cause de son enfant." Il a dit : "Les nourrices étaient parmi celles que l'homme repoussait lorsqu'il voulait avoir des rapports. Elle lui disait : 'Je ne te quitterai pas, car j'ai peur de tomber enceinte et de tuer cet enfant que j'allaite.' L'homme appelait alors la femme, lui disant : 'J'ai peur de te toucher et de tuer mon enfant.' Il la laissait alors et ne la touchait pas. Allah, exalté soit-Il, a interdit que l'homme lèse la femme ou que la femme lèse l'homme."

7. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from al-Hassan ibn Mahbub from ibn Sinan who has said the following: “I once asked abu ‘ Abd Allah, ‘Alayhi al-Salam, about the case of a man who dies and leaves behind a woman with a child from the deceased and she gives the child to her servant for breastfeeding. She then asks the executor of the will to pay for the breastfeeding wages. He (the Imam) said, ‘She deserves an equivalent wages and the executor of the will cannot take the child away from her until he grows up. He then delivers his assets to him.

Un homme est décédé en laissant une femme avec un enfant. Elle confia l'enfant à sa servante pour l'allaiter. Ensuite, elle est venue réclamer l'enfant au tuteur légal. Celui-ci lui a dit de lui payer un salaire équivalent à celui de l'allaitante et qu'il n'avait pas le droit de retirer l'enfant de chez elle jusqu'à ce qu'il atteigne l'âge adulte et qu'on lui remette sa part d'héritage.

8. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Muhammad ibn Khalid from Sa‘d ibn Sa‘d al-Ash‘ariy who has said the following: “I once asked al-Rida’, ‘Alayhi al-Salam, about the case of a child; if he can be breastfed for more than two years. He (the Imam) said, ‘It is two years.’ I then asked, ‘If the child is breastfed for more than two years do parents owe anything?’ He (the Imam) said, ‘No, they do not owe anything.

J'ai demandé à l'Imam Abu al-Hasan al-Rida (que la paix soit sur lui) au sujet de l'allaitement d'un enfant pendant plus de deux ans, il a répondu : "Deux ans." J'ai demandé : "Et s'il dépasse deux ans, est-ce que les parents ont quelque chose à voir avec cela ?" Il a répondu : "Non."
