2. A number of our people have narrated from Ahmad ibn Muhammad from and Ali ibn Ibrahim has narrated from his father from ‘Uthman ibn ‘Isa from Sama‘ah who has said the following: “I once asked him (the Imam), ‘Alayhi al-Salam, about the case of a man who says that on the day I will get married to so and so she is divorced. He (the Imam) said, ‘It does not have any valid effect until he has a binding marriage.’”

Il n'y a pas de divorce tant que le contrat de mariage n'est pas possédé.

3. A number of our people have narrated from Ahmad ibn Muhammad ibn ‘Isa from al-Husayn ibn Sa‘id from Hammad ibn ‘Isa from Shu’ayb ibn Ya‘qub who has said the following: “Abu ‘Abd Allah, Alayhi al-Salam, has said, ‘Those who were before us would say, ‘Setting free of a slave or divorce does not have any valid effect until a man has an ownership and marriage.’”

a dit : "Ceux qui étaient avant nous disaient : Aucune affranchissement ni répudiation ne sont valables avant que l'homme ne possède."

Muhammad ibn Ja‘far al-Razzaz has narrated from Ayyub ibn Nuh and Abu Ali al-Ash‘ariy has narrated from Muhammad ibn ‘Abd al-Jabbar from Safwan ibn Yahya from Hariz from Hamzah ibn Humran from ‘Abd Allah ibn Sulayman from his father who has said the following: “Once I was in the Masjid when Ali ibn al-Husayn, Alayhi al-Salam, came and I could not recognize him. He (the Imam) had a black turban and he had allowed both ends of the turban to hang down between his two shoulders. I then asked a man sitting near me, ‘Who is this Shaykh?’ He asked, ‘Why did you not ask me about people other than this shaykh coming in the Masjid?’ I replied, ‘Because I did not see anyone else entering the Masjid look as good as this Shaykh and his condition in my eyes, thus I asked you.’ He then said, ‘This is Ali ibn al-Husayn, Alayhi al-Salam .’ The man, others and I stood up. We surrounded him (the Imam) and offered greetings of peace. A man then said, ‘I pray to Allah to keep you well, what is your view about a man who mentions a woman exactly and on the day of his marriage says three times that she is divorced but then he decides to marry her: if he can do so.’ He (the Imam) said, ‘Divorce is only after marriage.’ ‘Abd Allah has said that my father and I visited abu ‘Abd Allah, Ja‘far ibn Muhammad, Alayhim al-Salam, and my father narrated this Hadith to him (the Imam). Abu ‘Abd Allah, Alayhi al-Salam, asked, ‘Will you testify that this is a Hadith of Ali ibn al-Husayn, Alayhi al-Salam ?’ He replied, ‘Yes I will do so.’”

J'étais dans la mosquée quand 'Ali ibn al-Husayn (que la paix soit sur lui) est entré, portant un turban noir dont les extrémités étaient passées entre ses épaules. J'ai demandé à un homme près de moi qui était ce cheikh, et il m'a répondu que personne d'autre que ce cheikh n'était entré dans la mosquée. J'ai alors dit que je n'avais vu personne entrer dans la mosquée avec une meilleure apparence que ce cheikh, c'est pourquoi je t'ai demandé à son sujet. Il m'a dit qu'il s'agissait d'Ali ibn al-Husayn (que la paix soit sur lui). Je me suis levé, d'autres se sont levés, nous l'avons entouré, lui avons rendu hommage et il a dit à l'homme : "Que Dieu te réforme pour avoir nommé ta femme du nom de son œil et avoir dit le jour où tu la divorces qu'elle est répudiée trois fois, puis il a pensé à la remariée, est-ce convenable pour lui ?" L'homme a répondu : "Le divorce intervient après le mariage." 'Abdullah a dit : "Je suis entré avec mon père chez Abu 'Abdullah Ja'far ibn Muhammad (que la paix soit sur lui) et mon père lui a rapporté ce hadith. Abu 'Abdullah (que la paix soit sur lui) lui a demandé s'il attestait de ce hadith concernant Ali ibn al-Husayn (que la paix soit sur lui), il a répondu : "Oui."

Ali ibn Ibrahim has narrated from his father from ibn abu Najran from ‘Asem ibn Hamid from Muhammad ibn Qays who has said the following: “I once asked abu Ja‘far, Alayhi al-Salam, about the case of a man who says, ‘If I marry so and so woman she is divorced; if I buy so and so slave, he is free and if I buy this cloth it is for the destitute. He (the Imam) said, ‘It does not have any valid effect; he cannot divorce until he is married and owns. He cannot give charity except what he owns.’”

J'ai demandé à propos d'un homme. Il a dit : "Si j'épouse une telle, elle est répudiée. Et si j'achète un tel, il est affranchi. Et si j'achète ce vêtement, il est pour les nécessiteux." Il a dit : "Il n'y a rien qu'il ne puisse répudier sauf ce qu'il possède, et il ne peut faire l'aumône qu'avec ce qu'il possède."
