Le Cas de Celui qui Mange Délibérément ou est Impliqué dans une Relation Charnelle Pendant le Mois de Ramadan

Ali ibn Ibrahim has narrated from his father from ibn abu ‘Umayr from ‘Abd Allah ibn Sinan who has said the following: “I once asked abu ‘Abd Allah, ‘Alayhi al-Salam, about a man who falls upon his wife (performs sexual relation) and does not find anything to give as charity to sixty destitute people. He (the Imam) said, ‘He is required to give charity as much as he can.’”

Concernant un homme qui a causé du tort à sa famille pendant le mois de Ramadan et qui n'a pas trouvé de quoi faire l'aumône à soixante pauvres, il est dit qu'il doit donner selon ce qu'il est capable.

4. Muhammad ibn Yahya has narrated from Muhammad ibn al-Husayn from Safwan ibn Yahya from ‘Abd al- Rahman ibn al-Hajjaj who has said the following: “I once asked abu ‘Abd Allah, ‘Alayhi al-Salam, about a man who in the month of Ramadan plays with his wife until semen discharge takes place. He (the Imam) said, ‘The expiation because of it is like that for having sexual intercourse.’”

J'ai demandé à Abou Abdullah (sur lui la paix) au sujet de l'homme qui plaisante avec sa famille pendant le mois de Ramadan jusqu'à avoir des rapports intimes. Il a dit : "Il doit expier comme celui qui a eu des rapports intimes."

5. A number of our people have narrated from Ahmad ibn Muhammad from ibn Mahbub from Hisham ibn Salim from Burayd al- ‘ Ij liy who has said the following: “I once asked abu Ja‘far, ‘Alayhi al-Salam, about the case of a man against whom witnesses testify that he has destroyed his fast of the month of Ramadan for three days. He (the Imam) said, ‘He is asked, ‘Is there a sin upon you because of destroying your fast of the month of Ramadan?’ If he says, ‘No, there is no sin,’ then it is the responsibility of the Imam to execute him. If he says, ‘Yes, there is sin, then it is the responsibility of the Imam to reprimand him.”’

Un groupe de nos compagnons de Ahmad ibn Muhammad, de Ibn Mahboub, de Hisham ibn Salim, de Burayd al-'Ijli a rapporté : Abu Ja'far (que la paix soit sur lui) a été interrogé au sujet d'un homme sur lequel des témoins ont attesté qu'il avait rompu le jeûne pendant trois jours du mois de Ramadan. Il a répondu : "On te demande si ton acte de rupture du jeûne pendant le mois de Ramadan est un péché. Si tu dis non, alors il revient à l'Imam de te tuer, et si tu dis oui, alors il revient à l'Imam de te punir en te frappant."

6. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from ‘Uthman ibn ‘Isa from Sama‘ah, who has said the following: “I once asked abu ‘Abd Allah, ‘Alayhi al-Salam, about a man who destroys his fast in the month of Ramadan three times and is brought before the Imam three times. He (the Imam) said, ‘He is executed on the third time.’”

Il doit être tué à la troisième fois.

7. Ali ibn Ibrahim has narrated from his father from ibn abu ‘Umayr from Hafs ibn Sawqah from those whom he has mentioned who has said the following: “I once asked abu ‘Abd Allah, ‘Alayhi al-Salam, about a man who plays with his wife or slave-girl while fasting for Qada’ (compensatory fast) of the month of Ramadan until semen discharge takes place. He (the Imam) said, ‘Its expiation is like that for having sexual intercourse in the month of Ramadan.’”

Dans le cas où un homme joue avec sa femme ou sa servante pendant le jeûne du mois de Ramadan et qu'il est submergé par le désir et éjacule, il doit faire une expiation similaire à celle de celui qui a des rapports intimes pendant le mois de Ramadan.

8. Humayd ibn Yazid has narrated from al-Hassan ibn Muhammad ibn Sama‘ah from more than one person from Aban ibn ‘Uthman from ‘Abd al-Rahman ibn abu ‘Abd Allah who has said the following: “I once asked him (the Imam), ‘Alayhi al-Salam, about a man who destroys his fast in the month of Ramadan purposely. He (the Imam) said, ‘He is required to give twenty Sa‘ in charity and make Qada’ (compensatory fast) that fast.’”

J'ai demandé à Abu 'Abdillah au sujet d'un homme qui rompt délibérément son jeûne un jour du mois de Ramadan. Il a dit : Il doit donner en charité vingt Sa' et compenser ce jour-là.

9. Ali ibn Muhammad ibn Bandar has narrated from Ibrahim ibn Ishaq al-Ahmar from ‘Abd Allah ibn Hammad from al-Mufaddal ibn ‘Umar who has said the following: “I once asked abu ‘Abd Allah, ‘Alayhi al-Salam, about a man who performs sexual intercourse with his wife when both are fasting. He (the Imam) said, ‘If she dislikes it, then he is responsible for the expiation for two people. If she is consenting, then he owes one expiation and she owes one expiation. If he forces her, there is fifty lashes on him which is half of the complete punishment, and if she is consenting, there is twenty- five lashes on him and twenty- five on her.’”

concernant un homme qui a approché sa femme alors qu'il était en état de jeûne et qu'elle aussi jeûnait, il a dit : "S'il l'a forcée, il doit expier par deux expiations, et s'ils ont agi de plein gré, il doit expier une fois et elle aussi doit expier. Mais s'il l'a contrainte, il doit recevoir cinquante coups de fouet à moitié du châtiment, et s'ils ont agi de plein gré, il doit recevoir vingt-cinq coups de fouet, et elle aussi doit recevoir vingt-cinq coups de fouet."
